Did Lady Justice Just Get Bitten By a Wolfe? You Decide.
By sheer coincidence, the judges who managed the Wolfe docket in the District Court of Columbia are all hardline Democrats. As Rex explains, a cynic could argue that Lady Justice never stood a chance.
As we now know, James Wolfe, the veteran security chief of the Senate Intelligence Committee (SSCI), received a sentence of just two months for 'lying to the FBI', which now appears to be the 'go to' felony for the Department of Justice, when it wants to frame people, or cover up corruption.
It's an astonishingly lenient outcome for Wolfe, who in March 2017 either conspired with others, or took it on himself, to leak to a reporter the unredacted Carter Page FISA application, made by Obama & Clinton's goons to the FISC in October 2016.
The SSCI is arguably the most corrupt Committee in Congress. If Wolfe didn't leak on his own volition, it's highly likely that he did so on instruction from Senators on the Committee itself - in particular, Mark Warner, an Obama/Clinton heavyweight, who when learning of Wolfe's arrest would have immediately sought protection from Obama holdovers, in the DOJ.
Leaking TOP SECRET intelligence : no charge?
Let's be clear : the Page FISA warrant application had the highest security classification possible, TOP SECRET. For a man in Wolfe's position, what he did was about the most serious offense possible.
Others have been jailed for far longer, for far less. Somehow, however, Wolfe was never indicted for this egregious breach of The Espionage Act. Instead, Judge Ketanji Brown Jackson was asked by the DOJ to consider yet another lame 'lying to the FBI' plea deal, with a sentence range of 0-6 months.
I was intrigued by the judge's refusal today, to consider an amicus brief by the victim of the leak : Carter Page himself. And her comments about Papadopoulos and Van der Zwaan, who were charged with lying (by Mueller) in totally different situations, were also very strange.
What an interesting insight into the mind of the judge, I thought. It appeared to reveal a partisan approach.
The Three Judges on the Wolfe Docket
Then I remembered : Judge Brown Jackson was a far-left Obama appointee. Not just that - an Obama favorite, who he was apparently considering as a SCOTUS judge, following Justice Scalia's passing in 2016.
There is insufficient space here, but a review of the judge's history appears to reveal a highly partisan, activist approach. This continues. For example, just recently, Judge Jackson invalidated POTUS Trump's 100% legal EO that sought to make it easier to fire federal employees, as well as set time limits on collective bargaining negotiations.
But when I checked the history of the Wolfe docket, I noticed another startling fact - Judge Jackson didn't take over the case until 19 June, 2018, thirteen days after Wolfe's arrest.
The first Judge to manage the docket, on 7/8 June 2018, was Judge Robin Meriwether, another Obama appointee and hardline Democrat.
Meriwether had once worked at Jenner & Block, one of the law firms that was a 'revolving door' with the Obama administration. Meriwether had also once been Judge Merrick Garland's associate and quite senior in Eric Holder's DOJ (she was Deputy Head of the District of Columbia Attorney's Office).
So : TWO Obama judges who appear to have a history of leftist activism, had managed the Wolfe docket. Surely, I asked, there couldn't be a third?
Just five days after Meriwether managed the docket, on 13 June 2018, a new judge took over: Magistrate Judge Deborah Robinson.
Many readers will recognize the name of the judge. It can be argued, with strong evidence, that Judge Robinson is one of the most partisan, left-wing judges in the US. Appointed by both Bill Clinton and Obama, Judge Robinson was the judge who dismissed a lawsuit brought against former Secretary of State Hillary Clinton, by relatives of victims of the 2012 Benghazi attack.
Judge Robinson was also the judge who sentenced the former White House official, Lewis Scooter Libby, to two and a half years in jail for, wait for it, leaking classified information (the identity of Valerie Plame).
You will recall Libby was later pardoned by POTUS Trump, as Libby's indictment was a disgraceful set-up by Special Counsel Patrick Fitzgerald (a Special Counsel appointed by none other than - drum roll - James Comey). This was all known, when Libby was sentenced.
Three Hard-Left Obama Judges, One Case : Coincidence?
It's interesting that at no time did any of these judges question the bizarre sequence of events that led from James Wolfe's leaking and arrest, to a slap on the wrist for a process crime.
Defenders of the judges will argue that judges can only sentence on what is put before them, by the DOJ. However, as Judge Emmett Sullivan's behavior in General Flynn's sentencing hearing this week demonstrates, that is simply untrue.
Judges have a discretion to get to the truth of a case, irrespective of the 'deals' struck by prosecution and defense. Indeed, they have a duty to do so. And they do it all the time, as we have seen on multiple occasions by Obama appointed judges, since POTUS Trump's inauguration.
Unless they decide not to. In the case of James Wolfe, it certainly appears that these three judges passes 'a blind eye' over glaring questions, about an extremely serious case involving national security.
Two months jailtime, for 'muh lying to the FBI? A major breach of Espionage Act, ignored?
Move along, nothing to see here.
Lady Justice : Is She Blind, or a Blind Hostage?
There's no doubt that all three judges have extremely impressive qualifications and experience. But it can't be denied that they are also all hard-left Obama progressives. It just seems strange that three partisan judges 'just happened' to manage the Wolfe case, from beginning to end.
Oh, before I go, how about this. Judges Ketanji-Brown and Robinson? They also managed the Manafort / Gates trial, brought by one Bob Mueller. They did so with Judge Amy Berman Jacakon, yet another hard-left progressive, Obama appointee.
'Well, how about that?', as the saying goes.
Look, it could be that all these connections are just a coincidence. Let's hope so.
Because a cynic may suggest they are not.
And that Lady Justice in America is, indeed, blind. But sadly, not in the way the framers intended her to be.
