Judge Sullivan: This Is Your Time - Deliver the Hammer Blow to Obama's Police State
The FBI interview of General Flynn conducted by Peter Strzok, revealed in redacted form this evening, was based on a transcript obtained from illegal surveillance, via unlawful FISA warrants, as well as illegal unmasking of General Flynn. In addition, as Rex explains, the FBI abused General Flynn's constitutional rights, in the way they lured the General into a meeting, under false pretenses. If that's how Judge Sullivan views what's happened, he will stand up tomorrow and put an end to these police state tactics, for the good of The Republic.
This evening, the original F302 of the 24 January 2017 interview between General Flynn and FBI agents Strzok & Pientka was publicly released, in redacted form, under an order by Judge Emmet Sullivan.
It is interesting to note that these documents were originally filed by Mueller's SC under seal. Mueller did not want them made public. Judge Sullivan disagreed.
What do they reveal? Well, they confirm General Flynn, POTUS Trump's NSA, chose not to tell the FBI agents the full extent of his interactions with the Russian ambassador Kislyak. These are the so-called 'lies' in Flynn's plea deal of 30 November, 2017, some ten months later.
Context is everything, however. On January 24, 2017 there may have been very good national security reasons not to reveal classified information to these FBI agents, in an informal interview. Also, in January 2017, it's highly likely that the new administration had little trust in Comey's FBI - and that Flynn wanted to be very careful, about how much to reveal to them.
That's not lying. In January 2017, it was a very good judgement call.
But what's arguably more significant from this evening's filings, is what the agents failed to disclose to General Flynn:
1. At no point does agent Strzok disclose that he was comparing General Flynn's responses to a transcript from an unmasked surveillance of General Flynn and Ambassador Kislyak. Remember, the surveillance and unmasking was in itself illegal - as it was founded in an illegal FISA warrant, likely obtained on General Flynn himself.
2. The General was never warned that the meeting was part of a secret entrapment operation, or if there were potential criminal consequences resulting from it. He was also not informed that FBI Director Comey himself, was part of the planning.
General Flynn had been given the impression from then Deputy Director McCabe that this interview was an administrative matter.
3. The interview was not held under oath. The McCabe/Strzok sting was to catch General Flynn relaxed and off-guard. You can see that the General was open with the agents through the interview.
As yourself this: if the FBI had advised General Flynn that Director Comey and Deputy Director McCabe were sending two agents to interview him about his discussions with Ambassador Kislyak, as well as his interactions with Putin's officials since 2012, do you think the General would have lawyered up?
Or agreed to meet at all? I doubt it.
Would the General have been so ready to co-operate if he'd been made aware that he'd been under surveillance via a FISA1 warrant for some time, his every communication transcribed and his identity unmasked?
I don't think he would have.
The General was denied this opportunity and had his constitutional rights abused. The evidence used by the FBI to interview him and then used to force a plea deal by Mueller, months later, was illegally obtained (via an illegal FISA and unmasking of his identity - the surveillance transcript with Kislyak).
As I see it, Judge Emmet Sullivan is not allowing Mueller's SC to avoid transparency about the FBI set-up of General Flynn in January 2017, nor the Mueller plea deal in November 2017. Both were based on illegally obtained evidence and are therefore tainted to the core.
If that's how Judge Sullivan views what went on, he will throw this plea deal out of his court. And deliver some fierce words to Mueller and his flawed witchhunt.
Let us hope and pray that justice is not just done, but is seen to be done. America cannot sustain this type of police state thuggery for too much longer. It's time for Judge Sullivan to stand up and deliver the hammer blow to Mueller's witchhunt, that it so richly deserves.
